Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mint Barcodes platform, including our website at https://mintbarcodes.com, the self-service dashboard at https://app.mintbarcodes.com, and all related services (collectively, the "Service"), operated by Devrika SRL, trading as Mint Barcodes ("Mint Barcodes", "we", "us", or "our"), a company registered in Romania, European Union.

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

1. Description of Service

Mint Barcodes provides a platform for businesses to obtain and manage GS1-compliant Global Trade Item Numbers (GTINs) and associated barcode assets. Our Service includes:

• Issuance of GTINs (EAN-13, UPC-A, ITF-14) under a licensed GS1 Company Prefix
• Generation of barcode image assets in multiple formats (SVG, PNG, PDF, EPS)
• QR code generation with GS1 Digital Link support (Sunrise 2027 compliant)
• A self-service dashboard for managing your barcode inventory
• Verification tooling to confirm barcode compliance

Mint Barcodes is an independent barcode services provider. We are not affiliated with, endorsed by, or a subsidiary of GS1 AISBL or any national GS1 Member Organisation. GTINs issued through our platform are traceable to a licensed GS1 Company Prefix that we administer on your behalf.

2. Account Registration

To use the Service you must create an account by providing a valid email address and a password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at legal@mintbarcodes.com if you suspect unauthorised access to your account.

You must be at least 18 years old to create an account. By registering, you represent and warrant that all information you provide is accurate and current.

3. Subscriptions and Payment

Access to the Service requires a paid subscription. Subscription plans, pricing, and included features are described on our pricing page and may be updated from time to time with notice.

All payments are processed by Stripe, Inc. By providing payment information, you authorise us to charge your payment method on a recurring basis at the then-current subscription rate. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.

Refund policy. Because GTINs are issued and immediately usable, all fees paid are non-refundable except where required by applicable law. If you cancel your subscription, you retain access to your issued GTINs and the Service until the end of the current billing period. We do not provide prorated refunds for unused portions of a subscription period.

We reserve the right to modify pricing with at least 30 days' advance notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

4. GTIN Licence and Intellectual Property

Upon successful payment, we grant you a non-exclusive, non-transferable, worldwide licence to use the GTINs issued to you for the purpose of identifying your physical or digital trade items in commerce. This licence is subject to compliance with these Terms and GS1 General Specifications.

Permitted uses. You may use your GTINs to:

• Identify and track your own products in retail, e-commerce, and supply chain contexts
• Submit product data to retailer catalogues (Amazon, Walmart, Target, Shopify, etc.)
• Print barcodes on product packaging and labels

Prohibited uses. You may not:

• Resell, sublicense, or transfer GTINs to third parties without our prior written consent
• Use a single GTIN to identify more than one distinct product variation (size, colour, or other attribute differences each require a unique GTIN)
• Use GTINs issued by Mint Barcodes to misrepresent product origin or manufacturer identity
• Reverse-engineer or attempt to extract the underlying GS1 Company Prefix for independent use

All barcode image assets, software, documentation, and other content made available through the Service (excluding your GTINs) are the intellectual property of Mint Barcodes or its licensors and are protected by copyright and other laws.

5. Retailer Acceptance

GTINs issued through Mint Barcodes are technically GS1-compliant and structured to meet Amazon Brand Registry, Walmart Supplier Portal, and similar requirements. However, acceptance of any barcode by a specific retailer is ultimately determined by that retailer's policies, which may change without notice.

We make commercially reasonable efforts to maintain compliance with current GS1 standards and retailer requirements, but we do not guarantee acceptance by any specific retailer or marketplace. Rejection by a retailer does not entitle you to a refund.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, crawl, or index any portion of the Service by automated means
• Use the Service to create competing products or services without our consent
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

7. Termination

You may cancel your subscription at any time via your dashboard settings. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your account immediately, without prior notice, if we determine in our sole discretion that you have violated these Terms, that your use poses a security risk, or that continued provision of the Service to you is no longer commercially viable. Upon termination, your right to access the Service ceases, but your issued GTINs remain valid for commercial use as described in Section 4.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINT BARCODES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MINT BARCODES, ITS DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO MINT BARCODES IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Mint Barcodes and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party right.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Romania and, where applicable, the law of the European Union, without regard to conflict of law provisions.

Any dispute arising under or in connection with these Terms shall first be subject to informal resolution by contacting us at legal@mintbarcodes.com. If the dispute is not resolved within 30 days, the parties submit to the exclusive jurisdiction of the competent courts of Bucharest, Romania.

If you are a consumer resident in the EU, you may also submit a complaint through the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Nothing in these Terms affects your rights as a consumer under applicable EU consumer protection law.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by displaying a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those changes.
